other Members an irrevocable, perpetual, non-exclusive, fully-paid,

information and content and to prepare derivative works of, or
incorporate into other works, such information and content, and to
grant and authorize sublicenses of the foregoing.
F) Your use of
the service is strictly at your own risk and you are solely responsible for your actions,
whether it be written, verbal or in person, with any other Member of
the Service. The Owner and its officers, directors, employees, agents,
affiliates and third parties assume no responsibility whatsoever for
harm that may come to you as a result of your contact (of any form)
with any other Member of the Service (including but not limited to
emotional, verbal and physical abuse or assault).
G) You will not
communicate, publish or display to any other Member any form of
defamatory, slanderous, offensive, inaccurate, abusive, profane,
obscene, threatening, harassing, racial, or illegal
material, or any other type of unlawful or
unacceptable material, as decided by the Owner. The Owner reserves the
right to remove any such material from the Service without notice.
H) You
will not use the Site, Services or your profile for any purpose other
than to seek other persons for meeting, friendship or dating; the
Service and profiles shall not be used for any commercial purpose
whatsoever (including but not limited to escorts, commercial or
non-dating solicitations, or otherwise).
I) You will not include
any contact information or identifying content of yourself or another
person in your profile. In the event that such unauthorized information
has been included in your profile (determined by the Site, in its sole
discretion) you authorize and agree that the Site may carry out the
following: (i) immediately suspend or remove your profile, until such
time as the breach is remedied; or (ii) remove or obliterate all or any
portion of such prohibited information, and allow the remainder of your
profile to be posted on the Site.
J) Please note you may be
involuntarily exposed to offensive or obscene materials on the Service
that may have been posted by Members, hackers or unauthorized users
from time to time. Please note that it is possible for others to obtain
your personal information and use it to engage in an action that may be
harmful to you or injure you. The Owner is not responsible for the use
of any personal information that you choose to display, publish or
distribute to other Members.
K)
You agree that you understand that when you gain access to this site,
you will be exposed to visual images, verbal descriptions and audio
sounds of a sexually oriented, frankly erotic nature, which may include
graphic visual depictions and descriptions of nudity and sexual
activity. You are voluntarily choosing to do so, because you want to

which doing so would, or could be deemed a violation of any law,
regulation, rule, ordinance, edict or custom.
P) The Owner assumes no responsibility whatsoever for your use of the
Service. It is for your sole, personal use and you may not distribute
your user name and password allowing others to use the service through
your membership. Use of the service is strictly prohibited to minors or
any person under the age of 18 (21-years old where 18 is not the age of majority), regardless of whether you have parental
consent.
Content posting on the Site/CDA: a) OUTChannel, Inc. claims immunity from liability to the fullest
extent under the law and as provided under the Communications Decency Act for
Content provided by third parties and members and nothing in this agreement is
intended to waive, remove, or usurp such immunity. You understand and agree
that OUTChannel, Inc. may delete any content, messages, photos or
profiles (collectively, "Content") that in the sole judgment OUTChannel, Inc. violates the Terms of Use or which might be
offensive, illegal, or that might violate the rights, harm, or threaten the
safety of OUTChannel, Inc. and/or its members.
B) You are solely responsible for the content that you publish or display
(hereinafter, "post") on InterracialDestination, or transmit to other OUTChannel, Inc. members.
Termination:
InterracialDestination™, OUTChannel, Inc., or You may terminate this agreement
at any time, for any
reason whatsoever, effective upon sending written notice to the other
party. If you send a notice of termination, your membership shall
concurrently terminate, without an obligation to make a payment, rebate
or refund on the part of InterracialDestination. InterracialDestination does however
reserve the
right to suspend or terminate your membership at any time, without
notice, if you breach this Agreement or any other terms and conditions
posted on the Site from time to time. InterracialDestination™, in its sole
discretion, may terminate your password, account (or any part thereof)
or use of the Service, and remove and discard any Content within the
Service, for any reason, including, without limitation:
a) for lack of use. Any trial or paid user that has not been seen on the system for over 120 days may be removed;
b)
if InterracialDestination™, OUTChannel, Inc. believes that you have violated
or acted inconsistently with the letter or spirit of the TERMS;
c)
any threat, real or implied, posed against InterracialDestination™,
OUTChannel, Inc. or any other system owned and operated by us, or its
personnel, employees, or its members made via the Service's mail
system, regular email or through any other media or delivery source.
d)
InterracialDestination™, OUTChannel, Inc., at any time discontinues providing
the Service, or any part thereof, with or without notice;
e) You
agree that any termination of your access to the Service under any
provision of these TERMS may be effected without prior notice, and
acknowledge and agree that InterracialDestination™, OUTChannel, Inc. may
immediately deactivate or delete your account and all related
information and files in your account and/or bar any further access to
such files or the Service. Further, you agree that InterracialDestination™,
OUTChannel, Inc. shall not be liable to you or any third-party for any
termination of your access to the Service. While InterracialDestination™,
OUTChannel, Inc. reserves the right to remove your account at anytime
for any reason at the web team's discretion. InterracialDestination™,
OUTChannel, Inc. is under no obligation to provide justification for
termination. If your account was removed in error or by software or
hardware failure InterracialDestination will make every effort to get you
setup with a new account as soon as possible. However, you will agree
to hold harmless InterracialDestination™, OUTChannel, Inc., its officers,
directors, employees, agents and third parties, for any losses, costs,
liabilities and expenses (including reasonable attorneys' fees)
relating to such account. The Web Team, InterracialDestination™, OUTChannel,
Inc., is not required to remove your information at your request. This
can be done by when selecting the "Remove My Account" option on the
"Main Menu" of the web site.
f) If your account has been disabled
for any reason and you cannot remove your account on your own, you
agree to email a written request for removal to
"irdestination@gmail.com" (InterracialDestination.com, OUTChannel, Inc.)
This request must postmarked within seven (7) days of the date your
access to the service was disconnected. InterracialDestination™, OUTChannel,
Inc. will have seven (7) days after the receipt of this request to
remove the account if, at the web team's discretion, the request is
valid and warranted. InterracialDestination™, OUTChannel, Inc. is without an
obligation and will not make a payment, rebate
or refund to you for any part of your remaining membership contract.
